Airport Curfew Violations Going Unpunished: Report

Airlines are not always adhering to the time restraints for when a flight is allowed to take-off from San Diego International airport, a recent story shows.

A story by NBC 7's media partners inewsource found airlines are violating the curfew in place and those violations often go unpunished.

The San Diego County Regional Airport Authority is allowed to fine airlines that allow flights to take off between 11:30 PM and 6:30 AM. The curfew is in place to limit noise and disturbance to nearby residents.

According to inewsource, airlines have broken curfew 217 times since 2010 and the Airport Authority has only fined airlines for 117 of those flights, or about half of the time it has happened.

The curfew only applies to departing flights. There is not a curfew in place for arriving flights. Airplanes are allowed to, and sometimes do land, at Lindbergh field at all hours of the day and night.

The fines the Airport Authority did collect resulted in $680,000 for the agency's general fund.

The Airport Authority told inewsource that the decision to not levy fines is often rooted in concern for safety. The Airport Authority doesn’t want an airline to have to make a choice between making the curfew or taking the time to fix something on the plane.
