Lindsay Lohan will be taking a legal gamble after turning down a plea deal.

Prosecutors said Lohan's lawyer notified them she would not be in court Friday. That was the deadline Los Angeles Superior Court Judge Keith L. Schwartz told the 24-year-old actress that she would only have to appear if she wanted to "plead guilty or no contest."

TMZ.com reports that Lohan is "firm about her innocence" and wants to "push it to the wall at trial."

Lohan is later scheduled to appear April 22 before Judge Stephanie Sautner for a hearing to determine if there is enough evidence to try her on the felony grand theft charge. That court date is also expected to include a hearing to determine if Lohan violated her probation in a 2007 misdemeanor DUI case.

Lohan is accused of walking out of Kamofie & Co. on Abbot Kinney Boulevard on Jan. 22 with a necklace valued at $2,500. She was charged Feb. 9 and is free on $40,000 bail.

A day after the charge was filed against her, Lohan issued a denial via Twitter, writing, "fyi -- I would never steal, in case people are wondering. I was not raised to lie, cheat or steal."

The jewelry store has since come under fire for releasing surveillance videotape of the actress inside the shop the day she allegedly stole the necklace. The store owners, Geoff and Sofia Kaman, have said they plan to eventually auction off the necklace and donate the proceeds to charity.
