Until then, it's a domestic partnership."..........-Pretty typical statement we keept hearing from prop 8 supporters who, in their arrogance, seem to think they are fighting to defend the status quo. "Until then, It's a domestic partnership". Actually chief, it's not. It's marriage right now. It's going to stay marriage as even if you people manage to pass your ballot measure, the supreme court still has every right to shoot it down again just as they did the first time. You can't just amend the constitution to change the definition of what is and isn't constitutional.................................................................@ Virgil - Amen brother, although I'm afraid the proponents of this measure are well beyond reason and rationale. They don't seem to want to recognize what America is, what makes it great, and the way it works, when it doesn't fit nicely into their own twisted and hypocritical moral views, which they somehow see as being patriotic and in protection of national security to force on everyone else. It's easy for them to wave the fear flag and scream how this will make marriage meaningless, but since these marriages have been taking place all year I would challenge any of them to go home to their spouse, look them in the eye, and tell them that their marriage means nothing anymore. A section below from fedaralist 78 on the judiciary is particularly relevant, and given that the people of California have taken legislative authority themselves through the ballot initiative, this attack on the power of the judiciary by the people is, if considered carefully, an attack on the spirit of our constitutional democracy. Mob rule against the legal rights of one minority is just as much tyranny as tyranny by legislature, or the executive. The Judiciary was given the task of judging the constitutionality of ban on same sex marriage by the executive (Gov. Schwarzenegger). The question being one of equal protection under the law. The supreme court ruled that equal protection demanded that same sex partners be given equal rights. The people through a ballot initiative overturning that decision is mob rule, plain and simple, and an offense against the principles this country was created to uphold. If the people decided by ballot initiative to says blacks, whites and hispanics can't marry outside their racial groups, would that be valid and legally defensible? Or that mixed race people can't marry at all. Think about it. NO ON 8, Fed. 78 below: The complete independence of the courts of justice is peculiarly essential in a limited Constitution. By a limited Constitution, I understand one which contains certain specified exceptions to the legislative authority; such, for instance, as that it shall pass no bills of attainder, no ex-post-facto laws, and the like.
