Source: Lindsay Lohan Will Not Make Court Date

Lindsay Lohan is due in court in Los Angeles on Thursday for a probation status hearing, but the starlet is still at the Cannes Film Festival in France – as a result, Access Hollywood has learned that she will not make it back in time.

A source told Access that there is no chance that the 23-year-old headline maker would be back in time for her at 8:30 AM court date, which a judge has ordered her to appear at.

According to TMZ, the starlet claims her passport was stolen while in Cannes. She reportedly attempted to fly back on Tuesday and even tried to board a plane without her passport and was then reportedly told she could not leave the country without the proper paperwork.

Earlier on Wednesday, Lindsay's lawyer, Shawn Chapman Holley, told Access, "I was on the phone with Lindsay's assistant the entire night and we're doing everything we can to resolve this issue and get her back to LA. Lindsay is distraught because it was her intention to get back to LA today to do more alcohol education classes and appear in court tomorrow."

Despite Lindsay likely being M.I.A., Access has learned that the scheduled hearing will go on.

On Wednesday, Lindsay's estranged father, Michael Lohan, sounded off on the latest development.

"I am very upset, as I am sure the judge will be, that Lindsay can not make it back, for whatever reason there is. Her 'situation' has to be addressed and I pray this delay doesn't further hurt her," Michael said in a statement to Access.

Michael went on to say he has a plan in place for Lindsay to get help.

"I also hope that Judge Revel meets with me as she promised (being that I have an attorney, Lisa Bloom, as the Judge requested.) It's obvious that Lindsay needs help, not incarceration, and I have a program and people in place that will satisfy the court and finally provide Lindsay with the help she needs to have her real life back," Michael continued. "On another note, I have met with Dina to resolve our differences, which I believe we have. I can honestly say, that we shared a much-needed moment of truth that ended with on a very positive note. I actually felt the old Dina that I married and truly love! Let's hope and pray for the best for my entire family!"

As previously reported on Access Hollywood.com, if Lindsay fails to show up at the mandatory court appearance, an arrest warrant could be issued for her.
