Man Sues Uncle Over Embarrassing FB Photos

A Minnesota man took his uncle to court for posting embarrassing childhood Christmas photos with "mean" captions, but an appellate judge threw out the case.

Aaron Olson, of Chisago City, Minn., appealed his previously dismissed petition for a harassment restraining order against his uncle, Randall LaBrie, according to the Technology & Marketing Law Blog.

Olson claimed he wasn't a Facebook friend of his uncle's, but his uncle accessed his childhood photos from his mother's Facebook account. Olson also accused his uncle of tagging him in the photos, captioning them with rude comments and making them public. LaBrie argued they meant for his "inner circle."

At the end of the day, it turns out to not matter. The court says that posting these types of photos to Facebook does not amount to harassment, and the comments offered by Olson as evidence were nothing more than “mean, disrespectful comments,” which cannot form the basis for liability.

Which is why Olson lost his appeal for a harassment restraining order. We're sorry to say we do not have the photos or comments, but we do know that at least one of the photos featured Olson as a child posing by a Christmas tree.

We would also like to point out all this wouldn't have happened without Olson's mom posting old photos. That's the danger of showing your mom how to use Facebook.
