A San Diego woman accused of killing her husband and teenage daughter in San Carlos told police that it was her husband who shot and killed their daughter.
Regina Johnson said after she saw her husband Reuben Johnson kill their daughter Aaliyah, which is why she grabbed the gun from her husband and killed him.
This new information comes from search warrant documents in Superior Court.
The documents reveal Johnson's claim that she and her husband were arguing, and that the couple's 14-year-old daughter stepped between them, to protect her mom.
Reuben Johnson then allegedly pulled the trigger, and killed their daughter.
Regina Johnson told police she then took the gun and shot her husband. She also told police that she put a blanket over her daughter's body and slept next to it for several days in their San Carlos condo, before telling her sister-in-law about the deaths.
One expert says evidence at the scene, and perhaps other statements, contradict Regina Johnson's claim, and allowed prosecutors to charge her with both murders.
"The [District Attorney] has an ethical duty to basically charge people with what they can prove, and not overcharge them and make them prove their way out of it,” said Marc Carlos, attorney and legal analyst.
Those court documents also reveal that police took more than fifty items from the crime scene... including a semi-automatic Smith & Wesson handgun, prescription medicines, in addition to a swab of apparent blood from a bedroom carpet.
Regina Johnson is currently being held without bail.
