The North County man accused in a Carlsbad school shooting will undergo a mental examination by prosecutors according to a published report.
Brendan Liam O'Rourke, 41, is charged with seven counts each of premeditated attempted murder and assault with a firearm.
O'Rourke allegedly jumped a fence at Kelly Elementary carrying a .357 magnum, pockets full of ammunition and a gas can on Oct. 8, 2010 during recess time and fired into the crowd of children.
The bullets grazed the arms of two little girls, then-aged 6 and 7.
"I saw a man holding a gun. He was close to the fence and he was yelling. I didn't understand him,” the oldest victim testified at a pretrial hearing.
“I heard really loud noises like an earthquake… My arm felt kind of weird… It was squiggly and you could see through it,” the girl testified. “It was really bad.”
O'Rourke has been seen by two court-appointed psychiatrists and a psychiatrist for the defense according to our media partner The North County Times.
On Thursday, a judge ordered the defendant be examined by a psychiatrist hired by prosecutors despite the defense's argument that prosecutors waited too long to request the exam the paper reported.No one was killed, thanks, in part, to the heroic actions of several men.
O'Rourke faces 103 years in prison if convicted on all counts.
