La Jolla Seals Can Rest Easy, For Now

City Attorney Mike Aguirre argues to keep the seals

Despite lots of legal huffing and puffing in court on the dispute over whether the city must remove the seals from the Children's Pool beach in La Jolla, no decision was made by the judge.

Lawyers involved in the case hoped Judge Yuri Hoffman would issue an order Tuesday afternoon.  But around noon, the judge's clerk said there would no ruling.

City Attorney Mike Aguirre, who argued the case himself, said he will immediately ask the state appeals court to overturn any order that requires the city to "shoo" away the seals.

Removing the seals right now "is going to create a huge conflict in the community," Aguirre said in court.

The hearing stems from a lawsuit filed by a woman who wants the beach dredged and harbor seals removed from Children's Pool 
so people can swim and bathing can resume.  Last month, Hoffman ordered the city to find out what permits are needed
to comply with the order to begin dredging. 

A 1931 state law granted the Children's Pool from the state to the city, provided it be used as a "bathing pool for children."
