San Marcos Attorney Guilty in Peeping Case

A North County defense attorney accused of secretly filming women at an Escondido tanning salon pleaded guilty to two misdemeanor counts Monday.

David Kaye, 43, of San Marcos was arrested in April 2010 after a 10-month investigation. He has an office on Palmer Way in Carlsbad.

Kaye originally faced nine misdemeanor counts and two felony counts for possessing child pornography and carrying a loaded, unregistered firearm.

In early 2010, police were told someone was reaching over a booth at The Tanning Place in Escondido and snapping images of women while they were in various stages of undress. During a sting operation, police observed Kaye videotaping a woman in another booth, according to Escondido Lt. Craig Carter.

Kaye pleaded guilty to two counts of peeking through a private area and filming another person. AS part of his probationary sentence, he has been ordered to attend sex offender treatment and to stay away from tanning salons.
