Carmel Mountain Ranch resident Jared Shirk told NBC 7 that all he wants is a good night’s sleep.
But he said that has been near impossible for the last few months since re-modeling construction began at a nearby Ralph’s grocery store. He told NBC 7 that noisy equipment rumbles from 10 p.m. throughout the night.
“Almost all night long, I hear generator noise. And then every 10 to 15 minutes, we hear the fork lift and or the cherry pickers, and they’re all night long,” Shirk said.
Shirk lives in an apartment on the 11000 block of Stoney Peak Drive. Several of the rooms face the back of the grocery store, where construction equipment is parked.
He said he's called the store and the police. He’s filed complaints on the city’s Code Enforcement division website but there has been no results. So he did what most people do these days to draw attention to the problem: he posted video on YouTube.
In one video, it shows a clock inside a car which read 12:32 a.m.
“The bottom line, it annoying. And as far as I can tell, it’s illegal,” Shirk said.

Per city municipal code, construction is not allowed between 7 p.m. and 7 a.m. A spokesperson with code enforcement says a case file was opened up on July 14. The case has now been sent to the city's Division of Building and Safety which will inspect the site.
If the store isn’t following the rules, a citation could be issued and ultimately construction could be halted.
Kroger, Ralph’s parent company did not respond immediately to phone calls from NBC 7.
But the company sent a tweet to Shirk that said in part: “we are very sorry about this.”
