Jury Deadlocked in O'Rourke Trial

The judge ordered them to return for further deliberation in the morning

The jury deciding whether a man was legally sane when he opened fire at Kelly Elementary School in Carlsbad deadlocked late Thursday afternoon.

But the judge ordered them to return for further deliberation in the morning, according to the courthouse clerk.

Jurors already convicted Brendan O'Rourke on seven counts of attempted murder and seven counts of assault with a firearm in connection with the shooting on campus in 2010.

After the conviction, the case moved into the sanity phase.
