A mistrial was declared in the penalty phase of an Escondido man convicted of torturing and murdering his girlfriend's 2-year old son.
Jose Castenada,24, faced the death penalty or life in prison without the possibility of parole. But on Monday jurors told the judge they were deadlocked 9 to 3 in favor of sending him to prison for life.
Castenada was convicted last week of torturing Cesar Razo for 10 months until the boy died in a hospital in 2005.
