A judge has thrown out a lawsuit that claimed the group behind SDSU West, one of two dueling redevelopment plans for the SDCCU Stadium site in Mission Valley, misused San Diego State University’s brand during its campaign.
The lawsuit was filed in April by the group behind SDSU West's competitor initiative, SoccerCity.
According to the claim filed by FS Investors, Friends of SDSU confused and misled voters into believing that SDSU West was endorsed by the university during a petition drive in order to get the initiative on the city’s November ballot.
A Superior Court judge rejected the lawsuit so SDSU West -- which aims to redevelop the Mission Valley Stadium site into a 35,000-seat stadium for the Aztecs football program along with a river park, campus expansion, and research center -- will not be removed from the November ballot, for now.
It will compete for votes with SoccerCity, with plans to build a stadium that could potentially bring a Major League Soccer Team to San Diego. It will also include housing, a river park, and a sports and entertainment district.
SDSU West championed the judge's decision Friday.
"Today’s decision also makes it clear that the frivolous FS Investors-backed lawsuit lacked any merit in its allegations," Friends of SDSU steering committee member Bill Hammett said.

Petitions were filed by the city of San Diego asking a judge to review the legality of both initiatives ahead of the November election. The city will make its case against SDSU West on June 15 and its case against SoccerCity on June 22.
