Husband Arrested in ‘Jogging Attack' Case

A man married to a woman who earlier said she was attacked jogging faces multiple charges.

Vicky Nikhil Pathak, 23, was taken into custody on Tuesday by Chula Vista police and faces charges that include torture, assault with a deadly weapon and false imprisonment.

The incident first came to police attention on March 3, when Pathak's wife said she had been attacked by two men at McCandliss Park. Police said the story broke down during questioning with the 23-year-old woman and her husband and that they later decided it had been concocted to cover up repeated beatings at the hands of her husband.

Investigators believe that the woman participated in the alleged ruse because she was in fear for her life. They have decided that they believe she was under extreme duress at the time and bears no criminal responsibility in the case.

After the initial reports to police, residents and police took part in a town hall meeting in the South Bay community, which occurred on the same day that John Gardner was arrested in the Chelsea King case. Chelsea was jogging in Rancho Bernardo Community Park when she was last seen.

Pathak is being held $500,000 bail. He is due in court on Thursday afternoon.
