Feds: Teacher Sent His Nude Pics to Student

A former middle school teacher is in federal custody charged with child pornography.

Monday afternoon, United States Attorney Karen Hewitt announced the unsealing of a criminal complaint charging Jay Kylee Bain with possession of child pornography. The federal complaint accuses the former middle school teacher of sending sexually explicit e-mails to a 14-year old student from 2005 to 2006.  

At the time, the now 37-year-old Bain was a teacher at La Presa Middle School in Spring Valley.  The girl is a former student.

The complaint  alleges that Bain sent graphic photos of himself and sexually suggestive e-mails to the minor. 

One reads in part: "Now remember, if you don't want to see hard core nudity ... then don't open the pics. However, if you do like what you see, I have plenty more. And, when am I going to get those sexy pics of u? Also, I am taking the day off next week and I was wondering if you wanted to too. " Prosecutors said the inappropriate exchanges took place between November 2005 and October 2006.

According to the complaint, Bain often asked when he could meet with the young girl.  At one point she questioned his interest: "Do you really like me that much or what? I mean I don't care or anything but wow...a teacher liking ME???? "

The complaint states Bain's response was, "Well, you're intelligent, funny, a fantastic writer, you have a great personality, and smokin hot body. "

The conduct was not reported until 2007. The student told investigators she was afraid nothing would happen to Bain. He was put on administrative leave from La Presa when the initial complaint surfaced in May 2007.

The case involves inappropriate conversations with at least one other former student.  Investigators said they also found  hundreds of child-porn images on the former teacher's personal computer.

If convicted, Bain faces up to 10 years in prison and a $250,000 fine. He will return to federal court Friday for a detention hearing.
