Attorney: K-Fed Won't Take Britney To Court Over Jayden's Hospital Visit

Kevin Federline isn’t eying a court date with Britney Spears after their son Jayden was hospitalized on Sunday, his attorney told E! Online on Tuesday.

“We’re pleased that someone was aware enough to see that he was having some sort of reaction and do what was necessary to make sure there were no chances taken and got Jayden to the appropriate facility and got the appropriate evaluation,” attorney Mark Vincent Kaplan told E!, mentioning Jayden likely fell sick with a “food allergy.”

Jayden James and brother Sean Preston are in Kentwood, La., with Britney, the first time she has been allowed to take them out of California since Kevin was granted full custody. According to a posting on Britney Spears’ Web site, “Jayden is fine” after being released from the Southwest Mississippi Regional Medical Center on Monday.

“We’re not going to jump to conclusions right now,” Kaplan continued.

Britney’s current visitation agreement could reportedly be halted if she was found to be providing negligent care, though this time that doesn’t seem to be the case.

“When you have kids it would be impossible for there to be some theoretical concept of negligence going on—a child falls down, anything that happens that way,” Kaplan said. “I don’t anticipate there being a hearing. I anticipate that Kevin and Britney as concerned parents will exchange information and satisfy themselves that what happened was a freak occurrence and do what they have to do to make sure that it doesn’t happen again.”

“Kids get hurt. Kids get sick,” he added. “Kids fall down, and by definition it’s their duty to do things that they’re not supposed to do. They’re kids. Especially at 2 and 3, these things will happen. The point is for the parents to try to minimize the possibility of these things happening.”

Kaplan noted that Jayden and Sean will be back with Kevin “shortly,” and that he would be taking Jayden to his local pediatrician.
