Court Rejects Apple's Proposed Samsung Ban

A U.S. appeals court rejected Apple's bid to ban the sale of Samsung's Galaxy Nexus smartphone.

The decision Thursday was a blow to the Cupertino, Calif. company and its extended patent dispute with the South Korean company, according to Reuters. Apple asked the Federal Circuit Court of Appeals in Washington, D.C. to appeal an October decision that would have imposed a sales ban on the Samsung smartphones.

Last year, Apple won a $1.05 billion verdict against Samsung in U.S. District Court in San Jose. The same judge, Judge Lucy Koh, will still preside over the continuing legal battle surrounding the Nexus phone. Some analysts said Apple faced difficult odds trying to ban the Samsung products. Apple could appeal to the U.S. Supreme Court, but it's not an easy road since patent fights have been made tougher for plaintiffs.

The Samsung-Apple litigation will likely continue, especially since Koh still can lower the $1 billion award for Apple, but as of yet, hasn't made a decision. We think it's good that the Galaxy Nexus won't be banned in this country because more products available on the market is better for the consumer.
