Court Revives Gay Couple's Case Against Kentucky Clerk Kim Davis

A Christian advocacy group representing the clerk is confident of victory

A federal appeals court revived a damages lawsuit against Kentucky county clerk Kim Davis, who refused to grant same-sex couples marriage licenses because of her religious beliefs in 2015, Reuters reported.

The 6th U.S. Circuit Court of Appeals in Cincinnati said a lower court judge was incorrect in finding that damage claims by David Ermold and David Moore became moot following a new state law excusing clerks from being forced to sign marriage license forms.

Though Ermold and Moore did receive a license, an appeals court panel said they could sue Davis for initially refusing to grant one. Their lawyer said the decision is a "no brainer."  

A Christian advocacy group representing Davis said they are confident they will prevail.
