A Valley Center family contacted NBC 7 Responds after an online return turned into a war of words and the company sending their bill to collections. 

Daniel Persichetti wheeled out a mini-bike that he and his wife Celia said are causing them major headaches. 

The Persichetti’s say the problem started when they went online and ordered a new $47 clutch assembly part for their son’s mini-bike that was not working. The family ordered the part from Mini Pocket Rockets. 

“So I opened it and it was not the part that I ordered on their website,” Celia Persichetti said. 

Celia and Dan said they decided to order the part through another vendor and return the other part to Mini Pocket Rockets. Celia said, when she called to return the product, the company argued the mistake was the Persichettis fault; the company was not responsible for delivering the wrong part. 

“It was just us against them and the frustration was starting to build up,” Daniel said. 

Celia said she asked the company to refund her money and take back the bike part but the company told her she would first have to pay for the shipping and restocking fees. Celia refused, saying it was the company’s mistake in the first place. 

“This part isn’t even offered on their website, so I do not know how I ordered this part,” Celia said. 

Celia said the part they had received looked nothing like the part featured on the family’s order form from the company and that the company should be responsible for shipping costs to return the product. 

When Celia cancelled the credit card payment to Mini Pocket Rockets, she said the company threatened to turn her bill over to collections and report her to police for being in possession of stolen property. 

“They can’t do this, it’s just not right,” Daniel said, “I wanted to be heard but no one was paying attention to me.” 

The Persichettis decided to contact NBC 7 Responds. After reaching out to Mini Pocket Rockets, a company spokesperson told us they would not send the bill to collections. 

In an email, a spokesperson for Mini Pocket Rockets sent us the following statement, “The part sent was exactly what she [Celia Persichetti] ordered. It did not fit her bike because (A) She ordered the wrong part on her own (B) The bike was not purchased from us and therefore, we cannot guarantee fitment for vehicles not purchased through us. Therefore, it is not our responsibility to pay for the return shipping (shipping to customer was under our free shipping promo). With that being said, and the amount being under $50, you can inform the customer that we will no longer be pursuing through collections for the amount owed to us.”
