Do Baena's divorce papers raise a red flag?

Legal questions are being raised about the legal leverage Mildred "Patty" Baena might have over former Gov. Arnold Schwarzenegger.

The birth certificate of the young boy in question lists Baena's ex-husband, Rogelio, as the father. Court records from their divorce, however, indicate that they separated a month after the child's birth. Her position changed in the 2008 filing, indicating the marriage did not produce any children. 

“She needed to go to court to legally establish paternity, that Schwarzenegger was the father within two years of the child’s birth,” said attorney Gloria Allred.

There has been no word yet from Baena’s ex-husband.

Schwarzenegger admitted having a child with the household staffer 10 years ago, a development that prompted his split with wife Maria Shriver.

The actor turned politician fathered the child before he turned to politics, but kept it a secret until recently from Shriver, his wife of 25 years, according to the Los Angeles Times, which broke the story Tuesday morning. Shriver moved out of their Brentwood mansion after Schwarzenegger revealed paternity of the child some time after his final term as governor ended.
