Lawyers for the Protect Marriage coalition on Monday answered the about-face Brown took last month in urging the state Supreme Court to strike down the new marriage law.
 
In a filing with the California Supreme Court, the coalition argued that Brown's claim that voters lacked the authority to deprive a minority group of a basic civil right was a "a hoary message" that invites "judicial triumphalism."
 
The brief comes as part of a series of legal challenges to Proposition 8 brought by same-sex marriage supporters after the ballot measure passed with 52 percent of the vote.
 
Brown initially said he would defend it in his role as attorney general.

  • @ No fan of JB Wednesday, Jan 7 at 12:30 AM FLAG COMMENT About that, I believe the reigning argument from the Right against those tax increases is that they did not garner the 2/3 majority electorate vote needed to pass. Very similar to the similar argument, which the supporters of 8 have been denying all along, against proposition 8 (in that it needed 2/3 electorate majority to be placed on the ballot). I can't decide whether that is irony, hypocrisy, or both.
