Miguel Sifuentes of California Tree Service cuts through the base of a carved "tiki" palm tree Monday morning. Oceanside officials required that the tree, on a city right-of-way, be cut down after it was carved without permission.

A battle between a local artist and a North County City enters a new phase when a set of carved palm trees are cut down.

The two tall palms towered over Freeman Street in South Oceanside. Last year, Steve "Tiki Daddy" Tustison carved the trees, which were on public right of way sidewalks. Crews arrived Monday at 7 a.m.; less than two hours later, they were both down.

City officials believe that the carving weakened the trees, creating a safety hazard, and officials said that a pair of arborists said they should be taken down.

"The city just can't take on the liability," Kiel Koger, Oceanside's maintenance and operations manager, told the paper.

Tustison disagreed.

"These are just bully tactics," Tustison said. "It's exactly what's wrong with this country."

The city said it planned on billing Tustison for the trees' removal.

  • Walt Tuesday, Jan 13 at 5:28 PM FLAG COMMENT Albert, that struck me too. If this person had right on his side why didn't he physical attack the individuals who were cutting down "his" trees? A neighbor of ours had an old RV the city wanted cited. When the "authority" came to do so my neighbor stabbed him to death. Not only did the neighborhood support this actions we actually chipped in to make his bail and held a block party to celebrate the killing. My wife painte ... MORE >
  • Albert Tuesday, Jan 13 at 4:50 PM FLAG COMMENT Now we have some more facts (Bunner). This person might have thought they were trees he owned, not the city. If he thought, however, that the trees were his he should have used whatever means required, including brute violence, to stop those people from cutting down his trees. Since he did not attempt to defend his property by killing those who were invading it, I think therefore he must have known the trees were not his. ... MORE >
  • Bunner Tuesday, Jan 13 at 2:40 PM FLAG COMMENT Oh come on - these trees were in front of his house, not in front of City Hall. Unless you happened to be driving down his street you'd never know they were there. It wasn't like he painted grafitti all over the place. I've seen them and they looked like they were on his property - I guess if they were a few feet closer to his house they would have been ok. I'm not a tiki person myself - but they were cool - unfortunately ... MORE >
