A video obtained by TMZ shows porn star Puma Swede topless on the tarmac at Montgomery Field in 2007.

GARDENA, Calif. -- A commercial helicopter pilot is asking for forgiveness for taking part in some in-flight entertainment with a porn star in the skies over San Diego.

David Martz let adult film actress Puma Swede perform a sex act on him while he flew over San Diego, but he said at a National Transportation Safety Board administrative hearing that he has learned his lesson and won't do it again.

Martz testified Tuesday that his actions during the May 20, 2005, flight weren't bright and he's much more responsible now. He sought to rescind a Federal Aviation Administration order revoking his license.

An FAA attorney contended Martz actions were so reckless and irresponsible that it doesn't matter if he's changed.

After a three-hour hearing Tuesday, NTSB administrative law Judge William R. Mullins upheld a Federal Aviation Administration order revoking Martz's license. Mullins said Martz committed gross negligence and cannot have his license back.

A passenger videotaped the scene in the helicopter and an edited version later surfaced. Mullins viewed the unedited tape in chambers and ruled quickly.

Martz is known for ferrying celebrities like rocker/fellow sex-video star Tommy Lee. And in the infamous video obtained by TMZ, a topless Swede is seen on the tarmac at Montgomery Field in 2007. She can then be seen on the video inside the chopper alongside Martz, buzzing over crowded freeways and neighborhoods. Shortly afterward, she leaned over and performed a sex act on Martz.

Puma said it was a way to repay Martz for allowing the crew to use his chopper and hangar at Montgomery Field.

Martz had his pilot's license suspended and revoked twice previously for flying recklessly. He was also once investigated by the FAA for flying dangerously close to an Los Angeles police helicopter near Van Nuys airport.
