New Judge, Trial Date Set For Marine's Widow

Einhorn Will Oversee New Proceedings, Officials Say

Judge John Einhorn has been assigned to the May retrial of Cynthia Sommer, the woman accused of poisoning her Marine husband to reap the benefits of his life insurance.

Sommer was found guilty in January, but granted a new trial in November after it was revealed her attorney made many mistakes throughout the trial process.

Sommer faces life in prison without the possibility of parole if convicted.

Sgt. Todd Sommer, 23, was in top condition when he collapsed and died on Feb. 18, 2002, at the couple's home on the Marine Corps' Miramar base in San Diego. His death was initially ruled a heart attack, though tests of his liver later found levels of arsenic 1,020 times above normal.

A jury convicted Sommer in January of first-degree murder by poisoning and for financial gain.

Sommer recently spoke with a reporter from Dateline NBC and talked about the night Todd died, saying that she tried to revive him and called 911. She said she still believes her husband died of food poisoning.
