Sheen is seeking joint custody of the pair’s twin sons, Max and Bob, and does not want a judge to award her spousal support, according to the AP. There is also reportedly a prenuptial agreement.
Mueller filed for divorce within hours of Sheen and seeks sole custody of their sons, the AP reported.
Back in August, Sheen pleaded guilty to misdemeanor third-degree assault stemming from a Christmas Day incident in Aspen, Colo. Mueller, 33, had accused the actor of threatening her with a knife.
In copping a plea deal, Sheen had two other charges dropped and avoided jail time over the incident. He was sentenced to 30 days in rehab, followed by as many days on probation and 36 hours of anger management.
Sheen and Mueller both went on to serve stints in rehab, and were said to have reconciled. But in court papers, Sheen lists Christmas Day as the date of separation, according to the AP.
According to People mag, which first reported news of the divorce, the pair has been living separately since April. They wed in 2008.
New York cops said last week they discovered Sheen early Tuesday trashing his Plaza hotel room in his underwear, while a woman later identified as a 22-year-old porn star hid in the bathroom.
When police arrived, "Sheen -- disturbed, disoriented and seemingly intoxicated -- removed his underwear to complete his rampage in the buff," NBCNewYork reported, citing a well-sourced law enforcement official.
Sheen was transported to a hospital and returned home to Los Angeles hours later.
His publicist, Stan Rosenfield, said at the time that the reason for Sheen’s meltdown was the result of “an adverse allergic reaction to some medication.”
Amid rumors of more hard partying after last week's incident, Sheen's manager insisted over the weekend that the actor was not locked in a downward spiral.
"I went over to Charlie's house earlier today because I was worried after reading Radar Online," an e-mail from Sheen's manager, Mark Burg, to his publicist said, MSNBC reported on Monday. "Complete bullsh-- fabricated lies!!! Charlie was alone watching Brett Favre getting beat up by New England. He looked at me like I was nuts for coming into his house. 'Dude, you could have knocked' he said. Charlie is fine and will be at work on Tuesday."
